This distinction is important. Current ICO guidance says marketing consent should be specific and involve a positive action; it should not simply be bundled into terms and conditions. The rules also provide a limited “soft opt-in” for marketing similar products/services to qualifying existing customers, subject to specific conditions and an opportunity to opt out.
